Re: [UUPoly-L] And yet another blog posting ...
Desmond, Your responses on the blog were generally good. However, in this
response you are making assumptions:
"It also means that anyone, man or woman, who marries a second spouse
without the knowledge and consent of the first spouse would be guilty of
violating the terms of the original marriage, similar to a spouse running
off with all of the family?s money is guilty of theft and abandonment."
That depends entirely on how the laws about multi-partner marriage are
crafted. Notification is not currently required for socially monogamous
marriage. Two people who want to get married can do so without telling any
friends or family members in advance, and no friends or family members can
prevent two people from getting married if they meet the legal requirements
for marriage. The kind of protection you imagine has to be put into a new
law because it's currently doesn't exist. And if conservative polygamists
get to lobby for how laws are created, then you might even have a fight on
your hands over that protection.
That's the kind of thing I've been talking about for awhile now. Your
opponents are going to come up with legal, economic, and social problems
that might be caused by legalizing multi-partner marriage. Polyamorists
really do need to conduct due diligence and provide solutions or rememdies
to anticiated problems if they are going to win the majority vote needed to
legalize multi-partner marriage.
