I guess as long as you are not audited the IRS would not know if you were married or not. If you were subject to one of those rare "let's check everything" audits, performed on returns selected at random, you would be required to prove your marital status - and I have it on pretty good authority that a civil union does not qualify.

I don't know how civil unions are regarded for state income tax purposes.
