Kenji Yoshino, a professor of law at Yale talks about this in regards to gay rights in his book
Covering: The Hidden Assault on Our Civil Rights.  I gather this interpretation is fairly
prevalent in the legal/civil rights community.

The book, however, is well worth reading.
